Estado pode ser condenado por obrigar Hospital de Picos a fazer serviços de IML
O Ministério Público do Trabalho (MPT) instaurou ação civil pública na Vara do Trabalho de Picos requerendo que o Estado do Piauí seja condenado pela utilização do corpo funcional e estrutural do Hospital Regional Justino Luz para a realização de exames cadavéricos e outras atividades próprias de Instituto de Medicina Legal nas dependências do hospital.
O procurador do Trabalho, Carlos Henrique Pereira Leite, pleiteia que a direção do hospital providencie imediatamente uma estrutura própria e adequada de recursos e pessoal para a realização de necrópsias e exames cadavéricos, devendo se abster de utilizar a estrutura e corpo técnico do Hospital Regional. Pelo dano moral coletivo, o Estado do Piauí pode ser condenado ao pagamento de multa de R$ 500 mil.
A investigação foi iniciada após denúncia feita ao MPT sobre irregularidades no ambiente de trabalho daquela unidade de saúde. Após inspeções realizadas pela Vigilância Sanitária Estadual, foi constatado que estava sendo utilizada a estrutura do hospital para atividades relacionadas ao IML, sem o mínimo respeito às normas relativas ao meio ambiente de trabalho. Além disso, a competência para a realização de tais procedimentos seria da Secretaria de Segurança Pública e não da Secretaria de Estadual de Saúde. Em audiência realizada na Procuradoria do Trabalho no Município de Picos, o diretor administrativo financeiro do Justino Luz, à época, Roberto Albuquerque Moita, admitiu ao procurador que “o hospital faz às vezes de IML, porque não existe Instituto Médico Legal em Picos”.
“O corpo funcional do Hospital Regional não possui o mínimo de treinamento necessário para exercer as atividades ligadas à medicina legal, além do fato de não serem disponibilizados equipamentos de proteção individuais específicos para a referida atividade, o que pode provocar altos riscos de contaminação”, argumentou o procurador Carlos Henrique.
